Chapter 1 – Title and Coverage

Article 1. Title. This enactment shall be called the 2005 Code of Health, Sanitation and Environment of Toledo City, Cebu. |

Article 2. Referral. This code may, however, be referred to simply as the Health Code and any citation, mention, quotation or reference to any provision as that of the Health Code shall mean this act. |

Article 3. Effectivity. This code shall take effect on July 1, 2005. |

|
Article 4. Coverage. This code covers and includes generally all matters that are related to the subjects of health, sanitation and environment and natural resources. |

Article 5. Evolution of this code. This enactment is a codification of all the ordinances passed by the local government of Toledo from the year 1945 up to the year 2003, traversing thru the stage of its being a municipality to its having become a city pursuant to Republic Act 2688. Upon the effectivity of this code, it shall become the repository of all ordinances of the city and all disputes on any existing ordinance shall be resolved on the basis of the provisions herein. |

Article 6. Rules of construction. The provisions of this code shall be applied in their ordinary concepts. But, where there are words and phrases which are of peculiar meaning, they shall be interpreted in the way and manner they are understood in the City of Toledo. |

Article 7. Intention. The intention of the Sangguniang Panlungsod and the City Mayor in adopting this code is to advance, promote and protect public health. Where there is conflict between private property right and upholding this code or any part hereof, the latter shall assume a higher hierarchy without prejudice to the obligation of the city to compensate fairly the affected private property. |
