Chapter 1 - Preliminary matters

Article 1. Title. This enactment shall be called the Public Order and Safety, Traffic and Zoning Code of Toledo City, Cebu.

 

Article 2. Referral. This code may, however, be referred to simply as the Public Order Code and any citation, mention, quotation or reference to any provision as that of the Public Order Code shall mean this act.

 
Article 3. Effectivity. This code shall take effect on July 1, 2005.
 

Article 4. Coverage. This code encompasses all subjects that are germane to making the city orderly, its residents enjoying peace, security and safety and its development and growth planned and programmed.

 

Article 5. Evolution of this code. This code is a  compendium and codification of all the ordinances passed by the municipal government of  the Municipal of Toledo from the year 1945 up to the year 1961 when Republic Act 2688 making it a city was passed. Then, this code also covers those ordinances of the City of Toledo since 1961 up the year  2003. Upon the effectivity of this code, it shall become the repository of all ordinances of the city and all disputes on any existing ordinance shall be resolved on the basis of the provisions herein.

 

Article 6. Rules of construction. The ordinary and logical concepts of terms used in this code shall be applied in construing its provision. But, where there are words and phrases which are of peculiar meaning, they shall be interpreted in the way and manner they are understood in the City of Toledo.

 

Article 7. Intention. To make the city orderly, peaceful and progressive using its police power is the intention of the Sangguniang Panlungsod and the City Mayor in adopting this code. Where conflict arises between the enjoyment of private property right and upholding this code or any part hereof, the latter shall assume a higher hierarchy without prejudice to the obligation of the city to compensate fairly the affected private property.
